DIRTY ROGER® — Terms of Service

Welcome to DIRTY ROGER®. "We", "us" and "our" refer to DIRTY ROGER® (ABN 77 204 089 897), a Western Australian business. Our store and website (the "Services") are powered by Shopify. By visiting or using our Services, you agree to these Terms of Service and our Privacy Policy. If you don't agree, please don't use the Services.

1. Your rights under the Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law (ACL) or any other law that cannot be lawfully excluded. Where our goods come with guarantees that cannot be excluded under the ACL, you are entitled to a replacement or refund for a major failure, and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if they are not of acceptable quality and the failure does not amount to a major failure. To the extent permitted by law, our liability for a breach of a consumer guarantee is limited to replacing the goods, supplying equivalent goods, or refunding the price.

2. Access and account
You confirm you are at least 18 (the age of majority in WA). You're responsible for the accuracy of the information you give us and for keeping your account details secure. You may not transfer or sell your account.

3. Our products
We do our best to represent our products accurately, but colours and appearance may vary depending on your screen and device. All items are made to order and printed on demand, so slight variation between prints is normal and not a fault. Product descriptions may change at any time, and we may discontinue or limit products at our discretion.

4. Orders
Placing an order is an offer to purchase. We may accept or decline any order at our discretion, and your order isn't accepted until we confirm it and process payment. Because items are custom-printed, we may be unable to change or cancel an order once it's accepted — please check your size, colour and design before ordering.

5. Prices and billing
Prices, discounts and promotions may change without notice. The price charged is the price in effect when you order, shown in your order confirmation. Prices are in AUD and, unless stated, exclude shipping. You confirm the payment details you provide are true and that you're authorised to use them.

6. Shipping and delivery
Items are made to order. Delivery times are estimates only and are not guaranteed. We're not liable for delays caused by carriers or events outside our control. See our Shipping Policy for details. (Nothing here limits your ACL rights.)

7. Intellectual property
All DIRTY ROGER® branding, artwork, designs, logos, text and images are owned by DIRTY ROGER® and protected by Australian and international law. You may use the Services for your personal, non-commercial use only. You must not reproduce, copy, resell or create derivative works from any DR branding or artwork without our written permission. All rights not expressly granted are reserved.

8. Third-party tools and links
The Services may include third-party tools and links (including our print and fulfilment partners) provided "as is" with no warranty from us. Use them at your own risk and check their terms. We're not responsible for third-party websites or products.

9. Relationship with Shopify
DIRTY ROGER is powered by Shopify. Any purchase you make is directly with DIRTY ROGER. Shopify is not responsible for any aspect of the sale, and you release Shopify and its affiliates from claims arising from your purchases with us.

10. Prohibited uses
You may use the Services for lawful purposes only. You must not use them unlawfully, infringe anyone's IP, harass others, transmit malware, scrape or extract data, or reproduce/resell any part of the Services. We may suspend or terminate access for any breach.

11. Errors
Occasionally there may be typos, inaccuracies or omissions in product info, pricing or availability. We may correct these and cancel affected orders at any time, even after you've ordered, without prior notice.

12. Disclaimer and limitation of liability
Except for the guarantees that cannot be excluded under the ACL (see clause 1), and to the fullest extent permitted by law, the Services and products are provided "as is", and we exclude liability for indirect, incidental or consequential loss. Nothing in this clause limits your rights under the ACL.

13. Indemnity
To the extent permitted by law, you agree to indemnify DIRTY ROGER against losses or claims arising from your breach of these Terms or your misuse of the Services.

14. General
If any part of these Terms is unenforceable, the rest still applies. Our failure to enforce a right isn't a waiver. These Terms are the entire agreement between us. You may not assign them without our consent; we may assign ours.

15. Governing law
These Terms are governed by the laws of Western Australia, Australia, and you submit to the courts of Western Australia.

16. Changes
We may update these Terms at any time by posting the updated version here. Continued use after changes means you accept them.
